Introduction

Organic Lighting Systems, Inc. (“Organic Lighting”) is concerned about privacy issues and wants you to be familiar with how we collect, use, and disclose your personal data. This Privacy Statement (“Statement”) describes our practices in connection with personal data that we collect through:

  • www.organiclighting.com, and any other website operated by us from which you are accessing this Statement (“Websites”);
  • The software applications made available by us for use on or through computers and mobile devices (“Apps”);
  • Our social media pages that we control from which you are accessing this Statement (“Social Media Sites”); and
  • HTML-formatted email messages that we send to you that link to this Statement.

Websites, Apps, and Social Media Sites are hereafter collectively referred to as the “Services”.

By providing personal data to us, you agree to this Statement. This privacy statement is also respecting the requirements of the EU General Data Protection Regulation (“GDPR”). This is why you will sometimes see some legal language as required by the GDPR.

Types of Personal Data we Collect

When you interact with Organic Lighting through our Services, we may collect various personal data, such as:

  • Your first and last name;
  • Your email address;
  • Your country;
  • Your telephone number;
  • Your IP address;
  • Your usage of and activities on our Services;
  • Your interests; and
  • Other information related to your online behavior.

If you submit any personal data relating to other people to us or to our service providers in connection with the Services, you represent that you have the authority to do so, and you permit us to use the data in accordance with this Statement.

How We Collect Personal Data

We and our service providers may collect personal data in a variety of ways, including:

  • Through the Services: We collect personal data through the Services, e.g., when you sign up for a newsletter, sign up for marketing activities, contact our support centers, or create an account.
  • Offline: We may collect personal data from you offline, such as when you visit our office or speak to one of representatives to purchase our products, attend one of our trade shows, place an order over the phone, or contact customer service.
  • From Other Sources: We receive your personal data from other sources, such as public databases, joint marketing partners, social media platforms such as Facebook, LinkedIn, Twitter, and YouTube (including from people with whom you are friends or otherwise connected), and from other third parties. In addition, if you elect to connect your social media account to your Website account, certain personal data from your social media account will be shared with us, which may include personal data that are part of your profile or your friends’ profiles.

For Which Purposes We Use Your Personal Data

We use your personal data for the following purposes:

  • Providing the functionality of the Services and fulfilling your requests.
    • To respond to your inquiries and fulfill your requests.
    • To send administrative information to you, for example, information regarding the Services, product tests, surveys, and changes to our terms, conditions, and policies. We will engage in these activities to manage our contractual relationship with you and/or to comply with a legal obligation.
  • Providing you with our newsletter and/or other marketing materials and facilitating social sharing.
    • To send you marketing communications that we believe may be of interest to you.
    • To facilitate social sharing functionality.
    • We will engage in this activity with your consent or where we have a legitimate interest.
  • Analysis of personal data for providing personalized services.
    • To personalize your experience on the Services, based on the information you choose to provide to us, by presenting products and offers tailored to you.
    • We will provide personalized services either with your consent or because we have a legitimate interest.
  • Allowing you to participate in sweepstakes, contests, or other promotions.
    • To allow you to participate in sweepstakes, contests, and similar promotions and to administer these activities. Some of these activities have additional rules, which could contain additional information about how we use and disclose your personal data. We suggest that you read any such rules carefully. We use this information to manage our contractual relationship with you.
  • Accomplishing our business purposes.
    • For data analysis, for example, to improve the efficiency of our Services;
    • For audits, to verify that our internal processes function as intended and are compliant with legal, regulatory, or contractual requirements;
    • For fraud monitoring and prevention and security monitoring, for example, to detect and prevent cyberattacks or attempts to commit identity theft;
    • For developing new products, enhancing, improving, or modifying our Services;
    • For identifying usage trends, for example, understanding which parts of our Services are of most interest to users;
    • For determining the effectiveness of our promotional campaigns, so that we can adapt our campaigns to the needs and interests of our users; and
    • For operating and expanding our business activities, for example, understanding which parts of our Services are of most interest to our users so we can focus our energies on meeting our users’ interests.
    • We engage in these activities to manage our contractual relationship with you, to comply with a legal obligation, and/or because we have a legitimate interest.

Sharing your Personal Data with others

We share your personal data with:

  • Organic Lighting affiliates for the purposes described in this Statement.
  • Organic Lighting Systems, Inc. is the party responsible for the management of the jointly-used personal data.
  • To our third-party service providers who provide services, such as website hosting, data analysis, information technology and related infrastructure provision, customer service, email delivery, auditing, and other services.
  • To third parties (such as Pardot), to permit them to send you marketing communications, consistent with your choices.
  • To third-party sponsors of sweepstakes, contests, and similar promotions.
  • To identify you to anyone to whom you send messages through the Services.
  • By you, on message boards, chat, profile pages, and blogs, and other services to which you are able to post information and materials (including, without limitation, our Social Media Sites). Please note that any information you post or disclose through these services will become public and may be available to other users and the general public. We urge you to be very careful when deciding to disclose any information on the Services.
  • To your friends associated with your social media account, to other website users, and to your social media account provider, in connection with your social sharing activity, such as if you connect your social media account to your Services account or log into your Services account from your social media account. By connecting your Services account and your social media account, you authorize us to share information with your social media account provider, and you understand that the use of the information we share will be governed by the social media site’s privacy policy. If you do not want your personal data shared with other users or with your social media account provider, please do not connect your social media account with your Services account and do not participate in social sharing on the Services.
  • To a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).

We also use and disclose your personal data as we believe to be necessary or appropriate: (a) under applicable law, which may include laws outside your country of residence; (b) to respond to requests from courts, law enforcement agencies, regulatory agencies, and other public and government authorities, which may include such authorities outside your country of residence; (d) to enforce our terms and conditions; and (e) to protect our rights, privacy, safety, or property, and/or that of our affiliates, you or others.

We use cookies and similar technologies in accordance with our Cookie Policy.

Your Rights

If you would like to request to review, correct, update, suppress, restrict, or delete personal data that we process, object to the processing of personal data, or if you would like to request to receive an electronic copy of the personal data you provided to us (to the extent this right to data portability is provided to you by applicable law), or you may contact us by: privacy@organiclighting.com. We will respond to your request consistent with applicable law.

In your request, please make clear what personal data you would like to have changed, whether you would like to have your personal data suppressed from our database, or otherwise let us know what limitations you would like to put on our use of your personal data. For your protection, we may only implement requests with respect to the personal data associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable and in any case within the time limits set by applicable law. Please note that we may need to retain certain information for recordkeeping purposes, or for a limited time even after you have contacted us. There may also be residual information that will remain within our databases and other records, which will not be removed.

If Organic Lighting’s collection and use of your personal data is based on your consent, you have the right to withdraw that consent at any time. Your withdrawal will not affect the lawfulness of Organic Lighting’s use of your personal data based on consent before the withdrawal.
